This new practical webinar will discuss the Internet of Things (“IoT”), which refers to the connection of everyday objects to the internet or other networks. We will explore the advantages, as well as risks of smart devices generally, in the context of potential medical device and pharmaceutical injury claims.  We also will discuss possible theories of liability for plaintiffs and will suggest best practices for mitigating liability in this emerging area of law.

Michael F. Buchanan

Michael F. Buchanan is a litigation partner focusing his practice on privacy and data security, white collar defense and investigations, and patent litigation. He has tried several complex civil and criminal cases to verdict and argued multiple appeals. Recently, he conducted an investigation on behalf of a financial services company regarding a potential data breach and provided counseling on breach notification and disclosure issues for the company. Mr. Buchanan spent over nine years at the U.S. Attorney’s Office for the District of New Jersey where he handled matters involving the Computer Fraud and Abuse Act, insider trading, the Foreign Corrupt Practices Act, health care kickbacks, off-label marketing, and Medicare/Medicaid and private insurance fraud. He was involved in some of the Office's most significant and high-profile prosecutions. During his tenure, Mr. Buchanan served as Chief of the Securities and Health Care Fraud Unit, Deputy Chief of the Criminal Division, and as Chief of the Terrorism Unit. Mr. Buchanan served as a Law Clerk to the Hon. Franklin S. Van Antwerpen in the U.S. District Court for the Eastern District of Pennsylvania.

Michelle M. Bufano

Michelle M. Bufano is a partner in Patterson Belknap’s Litigation department. She has represented major pharmaceutical and medical device companies in complex products liability and mass tort litigation for over 15 years, including class actions, multi-district litigations and coordinated proceedings in state courts. She has represented clients in litigations involving prescription and over-the-counter drugs, as well as a wide range of medical devices, including catheters, feeding tubes, as well as hip and knee implants.  Recently, Ms. Bufano successfully assisted a client by reducing a 7,600-case mass tort litigation to approximately 4,000 cases through dispositive motion practice. She also served as a core member of the national litigation team and counsel of record for all cases in that litigation. Following law school, she served as a law clerk to the Honorable Martin L. Greenberg in New Jersey Superior Court.

John D. Winter

John D. Winter has focused his practice on the defense of pharmaceutical and medical device cases. A member of Patterson Belknap since 1990, Mr. Winter has tried or argued the appeal of more than 50 product liability cases in state and federal courts throughout the United States. He has also acted as national counsel for pharmaceutical, consumer product, and medical device manufacturers in consolidated proceedings in state and federal courts. Chambers USA has recognized Mr. Winter as a notable practitioner nationally in the field of product liability and mass torts. Clients have stated that he is "phenomenally experienced and practical" and "very knowledgeable about regulatory issues with the FDA.” Clients have also noted that he has “very good judgment” and is “always accessible and very responsive.”  Prior to joining Patterson Belknap, Mr. Winter served as Law Clerk to the Hon. John M. Cannella, U.S. District Judge for the Southern District of New York.
