Ecommerce sellers often wonder whether to charge sales tax to consumers who reside outside their home state. It’s a challenging issue that hinges on the concept of nexus, a company’s presence in a state that warrants registering and filing with the state. If “presence” sounds a little vague, that’s because states set their own rules for what defines presence.

Nexus rules are constantly changing, as states redefine rules for what obligates a company to collect and remit sales tax. Adding to the complexity is the South Dakota v. Wayfair U.S. Supreme Court ruling that has just been handed down and could potentially impact many remotes sellers. This new decision has implications for ecommerce companies that might create a new set of obligations and challenges ahead of them.
