2019 Overtime Update: What You Need to Know

May 21 is the deadline to submit comments on proposed rulemaking that would raise the salary threshold for certain white-collar workers to be exempt from minimum-wage and overtime-pay requirements under the Fair Labor Standards Act.  However, potential federal rulemaking to revise existing requirements has been in the news since 2016, causing some confusion about the status of current rules, what changes could occur under proposed rules, when any changes would take effect, what effect these changes could have on state requirements and what any changes would mean for payroll departments. The current proposal, which was issued in March, could affect not only the white-collar salary threshold, but also certain pay requirements for highly compensated employees, and thresholds for U.S. territories and those working in the movie industry. New laws continue to bring many changes for payroll professionals in 2019. Changes to wage and hour administration at both the federal and state level are expected to continue in 2019, including a new overtime rule. Clarification of a big, expected change involving adjustments to federal income tax brackets and Form W-4 withholding rules should come in 2019, which the IRS plans to implement in 2020, and states reactions will follow, with some already taking action. Employers in 22 states must calculate unemployment taxes for 2019 using taxable wage bases that differ from those from 2018, and new taxes are being administered by unemployment agencies to fund leave programs.
