Top 10 Current PTAB Topics and How They Affect Your Practice

The webinar will start with an introduction on the general trends at the PTAB this past year. Back In quarter 1, the PTAB saw the most petitions it had ever seen, and some people were predicting 2017 to be a record-setting year in IPRs. That quickly slowed down as Q2, Q3, and Q4 were all lower than the previous quarter (and lower than their corresponding quarter from the year before). This is likely happening for a number of reasons: Alice/101, previous invalidations, fear of filing suit due to attorneys fees being asserted, among other things.  This is also tied to the general decrease in patent litigation filings (only ~4,000 complaints filed in 2017 compared to ~5,800 in 2015 according to Law360). Likewise, decisions from the PTAB are less and less lopsided toward petitioners, making IPRs less of a sure win, therefore driving up the risk of filing a parallel proceeding to already costly district court litigation.
